Shabalala Attorneys was first established in December 2011 in Johannesburg, Park town. The firm was renamed in T Shabalala Attorneys Inc in 2018. Its main office is situated in Brooklyn, Pretoria, while another branch is situated in Scottburgh, KwaZulu-Natal. The firm provides high quality of work and renders excellent service to all clients. T Shabalala Attorneys Inc believes in attracting work through the quality of its service.

WE ARE PRO BONO

At our core is a belief that justice should be equal for all. Our pro bono department provides free legal services to various organizations and communities, many of them from informal settlements in and around Johannesburg.

Our involvement in the Business Place project sees us provide free weekly legal advice to start-up entrepreneurs. We also provide legal services to individuals and institutions working for gender equality as well as a number of non-profit organizations. This is just some of the work we do pro bono, which you’ll have the opportunity to become involved in.

AREAS OF PRACTICE

ESTATE PLANNING

We provide the following services: drafting of wills and testaments, acting as Executor, limitation of liability for estate duties, resolution of disputes between heirs and beneficiaries, and winding of deceased estates.

FAMILY LAW

We focus on all aspects of law relevant to the enforcement and protection of individual’s rights in personal relationships. We recognize the very personal and sensitive nature of Family Law and we are committed to providing an efficient, effective and comprehensive service to our clients. Due to the vast range of issues that impact upon Family Law practice, we have built a network of skilled professionals – including mental health practitioners, forensic accountants, financial advisors, actuaries and valuers – with whom we consult, where relevant, to enable us to tackle problems holistically on the basis of sound advice.

COMMERCIAL AND CORPORATE LITIGATION

We specialize in handling major and complex litigation which arise from disputes concerning both local and international transactions. We have a broad range of expertise which ensures that all matters can be undertaken and completed timeously and satisfactorily in the most cost-effective manner.

CIVIL AND CRIMINAL LITIGATION

Our firm conducts defense on behalf of clients charged criminally. Bail applications are brought on behalf of arrested clients. We study the contents of the State’s dockets, hold consultations with clients, and furnish opinions to the client regarding their legal position and the manner in which the relevant defence ought to be conducted. Trials are conducted by our firm's attorneys. Appeals are prosecuted on behalf of clients. The aforesaid services are rendered on a cost effective basis and all fees debited are in accordance with the recommendations of the relevant Law Societies of South Africa.

LIQUOR LICENCES

T Shabalala Attorneys Inc. handles various liquor license applications and license renewals on behalf of our clients. We advise on the specific requirements for liquor license applications and assist our clients in the submission of their applications and ensure that all necessary terms have been fulfilled.

ROAD ACCIDENT FUND CLAIM

EMPLOYMENT LAW

Every organization gets entangled with Labour issues and our attorneys have vast experience of attending to matters through the present different procedures of our Labour system. We handle all disputes that arise from employment relationships. We represent our clients in all processes of Labour dispute resolutions. Our firm has expertise to handle dispute related matters including, but not limited to, dismissal or misconduct, poor performance and operational requirements.

IMMIGRATION LAWS

Having the appropriate legal partner when seeking immigration assistance is essential. We offer this together with our extensive, all-encompassing range of immigration services. Our immigration unit comprises specialists in this field and provides services which include temporary residence applications, permanent residence applications, visas, applications for dual-citizenship and resumption of citizenship, corporate permits and corporate worker permits, general work permits, quota work permits, exceptional skills permits, intra-company transfer permits, business permits, study permits, voluntary work permits and accompanying spouse or parent permits.

INSURANCE LITIGATION

Insurance law is one of the strengths of our firm. Our team handles a broad range of matters, which include: advice on policy interpretation, advice in matters relating to pension funds and life cover, advice in relation to legislation which governs both short and long term insurance, liability arising out of mining accidents, occupational injuries and diseases, medical malpractice and personal injuries, litigation, arbitration and dispute resolution arising in all areas relating to insurance.

THE FOUNDER

T Shabalala Attorneys Inc is 100% Black owned. Themba Shabalala is the founder of the firm. He holds LLB and LLM in Corporate Law. He graduated from the University of KwaZulu-Natal in 2006 with an LLB Degree. He was then employed as a Candidate Attorney at Mooney Ford Attorneys in 2006 and completed his articles at said firm. During his time at the firm he completed his Professional Legal Training in 2008 at the University of KwaZulu-Natal and was subsequently admitted as an Attorney of the High Court, and obtained his Right of Appearance in the High Court of South Africa in 2009. He was then appointed as Professional Assistant at the same firm. During his tenure at the firm he dealt with various matters, which included but was not limited to, Road Accident Fund Claims, General Litigation, Labour Law, Criminal Litigation, Immigration Law, Pension Law, Insurance Law, Protecting Land Tenure Rights, Evictions, Debts Collection, Liqour Licence and Winding up of Estate.

By 2010, Themba was the founder of Shabalala Attorneys, where he worked as an Attorney and dealt with various matters which includes Road Accident Fund (as a Plaintiff), General Civil Litigation, Deceased Estates, Local Government, Labour Law, Immigration Law, General Corporate and Commercial Law.

By 2014, Themba had decided to engage more in the corporate and commercial litigation field. He was in a skill transfer programme at Webber Wentzel Attorneys, dealing competently with public and private mergers and acquisitions, cross border transactions, corporate structuring, JSE listing requirements and takeover regulations. His venture came to an end by November 2014 and he went back to his main business T Shabalala Attorneys Inc.

During his professional career, Themba has obtained various achievements, namely:

2005: Chosen by the Law Society of South Africa’s Legal Education and Development to participate in the Integrated Bar Project;
2005: Mock Trial semi-finalist at UKZN Westville Campus;
2005: UKZN Westville Campus’ Project Officer of the Law Student Council;
2007: Attended the “best use of CCMA and Law” seminar;
2008: Attended Protecting Land Tenure Rights on Legislation ESTA & LTA;
2008: Awarded the Outstanding Performance Certificate by Legal Education & Development;
2008 - 2009: A board member on behalf of Meyrick Bennet Child Guidance;
2011: Certificate of Attendance at three (3) months Conveyancing Course;
2012: Founder and Trustee of Ladysmith Educational Trust Fund; and
2014: Certificate in Commercial Training Programme;
2018: Practice Management Training Course Certificate;
2018: LLM in Corporate Law (University of Johannesburg).
